RE:ASSIGNMENT OF CASES PASSED DURING JURY TRIAL WEEK

In order to provide for the assignment of cases passed during jury trial week, it is

ORDERED:

1. When a case is passed during jury week to another judge, all post-trial motions are to be heard by the judge presiding over the case. However, the case shall remain in the section to which it was originally assigned.

2. If the trial is mistried or concluded but needs to be retried because of post-trial motions or reversal on appeal, the case will remain in the section to which it was originally assigned and will be retried by the judge assigned to that section.

Administrative Order PI-CIR-97-35 is hereby rescinded.
