ADMINISTRATIVE ORDER NO. PI-CIR-97-32 S1797032
RE: INJUNCTION FOR PROTECTION: CASE ASSIGNMENT
In order to reduce or eliminate conflicts which may arise from the entry
of multiple orders pertaining to custody and welfare of children and injunctions
relating to domestic violence, it is
ORDERED:
1. Upon the filing of any action arising under the provisions of Chapter
61, Florida Statutes, (Dissolution of Marriage; Support; Custody) the Clerk
shall determine if any action involving the same parties instituted pursuant
to Section 741.30, Florida Statutes, (Injunction for Protection) is pending,
and, if so, the Clerk shall cause the action to be assigned to the Family
Law Section to which the prior action is assigned.
2. Upon the filing of any action arising under the provisions of Section
741.30, Florida Statutes, (Injunction for Protection) the Clerk shall:
a. Determine if any action involving the same parties, instituted pursuant
to Chapter 61, Florida Statutes, is pending; and, if so, shall cause the
action to be assigned to the Family Law Section to which the prior action
is assigned.
b. In the event the Petition for Injunction for Protection seeks relief
affecting the custody of minor children, determine if any proceeding instituted
pursuant to Chapter 39, Florida Statutes, (Delinquency/Dependency) and pertaining
to such children is pending. The Deputy Clerk presenting the Petition for
Injunction for Protection to the Court for consideration shall advise the
Court of such determination.
3. Pinellas Administrative Order 86-22 is hereby rescinded.
