RE: INVOLUNTARY
COMMITMENT OF SEXUALLY VIOLENT
PREDATORS
In order to
consolidate the handling of proceedings for the Involuntary Civil Commitment of
Sexually Violent Predators, section 394.910 et.seq, Florida
Statutes, (Jimmy Ryce Act) in
ORDERED:
1. Section 60 is continued as a section within the Civil Division of the Circuit Court, in and for Pinellas County Florida.
2. The State Attorney may request an order seeking return of a respondent for a determination of counsel and a determination of indigence prior to filing a petition for the Involuntary Civil Commitment of a Sexually Violent Predator, pursuant to section 394.910, et.seq, Florida Statutes. The request shall be made to the judge assigned to section 60.
3. When the Clerk of the Circuit Court receives a petition for the Involuntary Civil Commitment of a Sexually Violent Predator pursuant to section 394.910 et.seq, Florida Statutes, the Clerk shall assign the case to section 60.
5. Petitions for attorney’s fees shall be in accordance with Administrative Order 2004-028 PA/PI-CIR or subsequent order regarding attorney’s fees and where court approval is required shall be directed to the judge assigned to section 60. Petitions for approval of fees for experts shall also be directed to the judge assigned to section 60.
This Administrative Order shall take effect January 1, 2009, at which time Administrative Order 2006-084 PI-CIR is hereby rescinded.
