RE: AMENDMENT
TO PROCEDURES FOR BOWEN AND SUBSEQUENT
REVIEW HEARINGS IN CASES INVOLVING INTRACIRCUIT EXECUTION OF WRIT OF
BODILY ATTACHMENT FOR CIVIL CONTEMPT FOR FAILURE TO PAY CHILD SUPPORT
In order to clarify which judge should review a hearing officer’s recommendation:
IT IS ORDERED:
Administrative Order 2006-021 PA/PI-CIR is hereby amended as follows:
A new paragraph 5 is added to read:
5. When a Bowen hearing is held before a child support hearing officer in the county where the contemnor was arrested and is being held, the hearing officer’s recommended order shall be presented for signature to any judge of the Family Division (including Unified Family Court if applicable) in the county where the Bowen hearing was conducted.
All other provisions of Administrative Order 2006-021 PA/PI-CIR remain in full force and effect.
