ADMINISTRATIVE ORDER NO. 2005-060 PI-CIR

RE:     PINELLAS CIRCUIT CRIMINAL SECTION T

 

            The Florida Legislature enacted SB 2048 which became Chapter 2005-150, Laws of Florida and created additional circuit judge positions in the Sixth Judicial Circuit.

 

            In order to create section T, a new section in the circuit criminal law division in Pinellas County,

 

IT IS ORDERED:

 

1.     Section T is created effective November 14, 2005. 

2.     The Clerk of Court shall:

 

a.      Effective October 15, 2005, reassign the following cases to section T

 

From section A, all the cases assigned to assistant state attorney

Marc Plotnik (SPN 02446471),

 

From section B, all the cases assigned to assistant state attorney

Shawn Smith (SPN 02197077),

 

From section D, all the cases assigned to assistant state attorney

Donald Kilfin (SPN 02154746), and

 

From section K, all the cases assigned to assistant state attorney

Doneene Dresback (SPN 02476051) and all cases assigned to SPN 02408281.

 

Violation of probation cases will not automatically be re-assigned with other cases to establish section T but may be re-assigned by request of the State Attorney on a case by case basis when a defendant’s charges in a case transferred to section T result in an alleged violation of probation in another case.

 

Cases with an attorney where the judge assigned to section T has entered an order of recusal shall not be transferred but shall remain in the currently assigned section.

 

When a case that has been resolved through pre-trial intervention is re-opened by one of the above assistant state attorneys, the case will be transferred to section T.

 

b.     Mail to defense counsel of record or defendants if pro se, notification of the reassignment with the following information:

 

                                                              i.     This case has been reassigned to new criminal section T.  Section T will open November 14, 2005. 

                                                            ii.     Matters that are currently scheduled to be heard prior to November 14, 2005 in the previously assigned section will continued to be heard in the previously assigned section. 

                                                          iii.     If you have matters to be heard prior to November 14, 2005, you should continue to schedule those matters in the previously assigned section.

                                                          iv.     Matters to be heard on or after November 14, 2005, should be scheduled in section T by contacting the judicial assistant.  She can be reached at 727.464.3882.  On and after November 7, the phone number to reach the judicial assistant will be 727.464.6494.

 

c.      Effective October 15, 2005 pre-trials which are continued or reset for the above cases and which are continued or reset on or after November 14, 2005, will be scheduled for section T.

 

d.     If the cases transferred pursuant to this order have a matter scheduled between October 15, 2005 and November 14, 2005 or a matter that needs to be heard in that time period, the matter shall continue to be scheduled and heard in the previously assigned section.

 

e.      Provide to the judges assigned to section A, B, D, and K a listing of cases transferred out of their section to section T.

 

f.       Provide the judge assigned to section T a listing of the cases that were transferred into the section.

 

g.      Effective October 24, 2005, all new information filed by the above assistant state attorneys will be set for arraignment in section T.

 

h.      Effective November 14, 2005, assign new cases to sections A, B, C, D, I, K, and T using an equal, at random, blind assignment system except that the Criminal Administrative Judge may modify the distribution of new cases to balance the workload.  

 

i.       Automatically re-notice any matter in a case that is transferred pursuant to this order and which is scheduled to be heard on or after November 14, 2005 in the previously assigned section.

 

3.   The Pinellas County Information Technology Department shall take immediate action to make changes to the CJIS system to implement this Order and take all actions necessary so that the Clerk of Court can perform the functions specified in this Order.
